Aggravated DUI in Arizona

The State of Arizona is known for having some of the strictest DUI laws in the country along with having a Sheriff who will make you wear pink underwear and live in a Tent should you be arrested for DUI! Arizona has the standard DUI/DWI charges with a BAC (Blood Alcohol Content) of .08. Arizona also has what’s called an Aggravated DUI charge which is a felony dui charge.

You can be charged with an Aggravated DUI in Arizona if this is your third DUI within the last 7 years or another circumstance exists such as: driving on a suspended license which was revoked for a prior DUI, if you have a child under the age of 15 in the car, or if you were involved in an accident with serious injuries or death as a result of your drinking.

The penalties for an Aggravated DUI in Arizona are:

  • Minimum sentence of 4 months in prison (can be up to 3.75 years depending on prior convictions if any, or if you have another Aggravated DUI on your record).
  • Drivers License revoked for minimum of 3 years
  • Additional probation of up to 5 years, depending on extenuating circumstances
  • Fines and Fees exceeding $5,000
  • Using an Ignition Interlock Device for a minimum of 2 years (An interlock device is attached to your car and requires you to blow into it before starting the car and you must blow into the device while driving to keep the car moving down the road. If you do not blow into the device, the car will stop.)
  • Mandatory Alcohol and Drug evaluation and treatment program

Clearly an Aggravated DUI charge in Arizona is no laughing matter. The punishments are severe and the consequences for driving that intoxicated can result in you or someone else’s death.
