Ozark Man Convicted on Counts of Rape, Sodomy

Christopher Carroll Lively, a 36-year-old Ozark man, was convicted this week of five sex-related charges the Dale County Circuit Court. It took the jury less than 30 minutes to return guilty verdicts on all five counts. The charges included first-degree rape and sodomy. According to authorities, the crimes were ongoing for almost a decade, as Lively committed various sex offenses against a girl under 16 years of age in multiple states.

The charges related to crimes believed to have taken place in 2010 when Lively lived in Dale County, according to Dale County Assistant District Attorney Cathey Berardi. At the time, the victim was less than 12 years of age. Lively remains to face sentencing, the date for which is to be set at a subsequent hearing.

First degree rape under the Alabama Criminal Code can be committed in three ways.

  1. A person engages in sexual intercourse with a member of the opposite sex by forcible compulsion;
  2. A person engages in sexual intercourse with a member of the opposite sex who is incapable of consent by reason of being physically helpless or mentally incapacitated; or
  3. A person 16 or older engages in sexual intercourse with a member of the opposite sex who is 12 or younger.

First-degree sodomy under the Alabama Criminal Code can similarly be committed in three ways:

  1. A person engages in deviate sexual intercourse with another by forcible compulsion;
  2. A person engages in deviate sexual intercourse with a person who is incapable of consent by reason of being physically helpless or mentally incapacitated; or
  3. A person who si 16 or older engages in deviate sexual intercourse with a person who is 12 or younger.

Both are Class A felonies, carrying with them a maximum sentence on each count of life in prison or 10-99 years.
